CISG had not been excluded in accordance with Art. 6 CISG and as the CISG had been in legal effect for both Austria and Germany at the time of the conclusion of the contract, it had to be considered as part of the respective domestic law. CISG advocates are also concerned that the natural inclination of judges is to interpret the CISG using the methods familiar to them from their own State rather than attempting to apply the general principles of the convention or the rules of private international law. For at state to adopt the CISG it is required that notification be deposited with the United Nations, after which the Convention will enter into force on the first day of the month following the expiration of twelve months after the date of the deposit of notification, being either an instrument of ratification, acceptance, approval or accession according to CISG article 99(2).
